7. Limitation of Liability

10.1 Users agree to comply with applicable Moroccan laws (including AMMC regulations, anti-money laundering, anti-corruption Law 37-10, and Law 09-08) as well as international laws where applicable.
10.2 CasaNext may restrict access to its Services in jurisdictions where offering such services is unlawful.
11. Changes to Terms
CasaNext reserves the right to update these Terms at any time. The “Last Updated” date indicates the latest version. Continued use of the Services constitutes acceptance of the updated Terms.
12. Governing Law & Jurisdiction
12.1 These Terms are governed by Moroccan law.
12.2 Any dispute shall be submitted to the exclusive jurisdiction of the courts of Casablanca, Morocco.

CasaNext FinCorp – Subscription Agreement Addendum

This Subscription Agreement Addendum (“Agreement”) governs the terms under which you (“Subscriber,” “you,” or “your”) access and use CasaNext FinCorp’s subscription-based services (the “Subscription Services”). This Agreement supplements and forms part of CasaNext’s Terms & Conditions. In the event of any inconsistency, this Agreement shall prevail for subscription-related matters.
1. Scope of Subscription
1.1 The Subscription Services may include, without limitation:

Premium financial research reports, analytics, and insights.

Real-time or delayed market data feeds.

Access to CasaNext’s digital tools, dashboards, or advisory products.

Newsletters, alerts, or publications restricted to paying subscribers.
1.2 CasaNext reserves the right to modify the scope of Subscription Services, provided that material changes will be communicated in advance.
2. Fees and Payment
2.1 Subscription fees and billing terms are communicated at the point of purchase and may vary by service level or geography.
2.2 Fees are payable in advance (monthly, quarterly, or annually) unless otherwise agreed in writing.
2.3 All payments are non-refundable except as required by law or explicitly stated in this Agreement.
2.4 Subscribers are responsible for any applicable taxes, levies, or duties.
3. Term and Renewal
3.1 Subscriptions commence on the date of purchase and continue for the agreed billing cycle.
3.2 Subscriptions automatically renew at the end of each billing cycle unless cancelled prior to renewal.
3.3 Subscribers may cancel at any time by following the cancellation instructions provided on CasaNext’s platform.
4. License and Usage Rights
4.1 CasaNext grants Subscribers a limited, non-exclusive, non-transferable license to use the Subscription Services for personal or internal business use only.
4.2 Subscribers may not:

Redistribute, resell, or publicly display CasaNext’s content without written authorization.

Extract, scrape, or systematically copy market data for external commercial use.

Use the Services to create derivative works or competing platforms.
4.3 CasaNext retains full ownership of all intellectual property, reports, data, and tools provided under the Subscription Services.
5. Account Management
5.1 Subscriber accounts are personal and must not be shared with unauthorized third parties.
5.2 CasaNext may monitor usage to ensure compliance with this Agreement.
5.3 Unauthorized sharing or misuse may result in immediate suspension or termination without refund.
6. Service Availability
6.1 CasaNext endeavors to provide uninterrupted access but does not guarantee continuous availability due to maintenance, system upgrades, or unforeseen disruptions.
6.2 Subscribers acknowledge that market data and research may depend on third-party sources, and CasaNext is not responsible for inaccuracies or delays beyond its control.
7. Termination
7.1 CasaNext may suspend or terminate subscriptions immediately if:

Payment obligations are not met.

The Subscriber breaches this Agreement or the T&C.

Required by law or regulatory authorities.
7.2 Upon termination, access to Subscription Services will cease, but obligations related to confidentiality, intellectual property, and outstanding payments remain enforceable.
8. Confidentiality
8.1 Subscribers agree to treat all premium reports, analytics, and data as confidential.
8.2 Unauthorized disclosure of proprietary content is strictly prohibited.
9. Limitation of Liability
9.1 CasaNext is not liable for investment losses, financial damages, or business decisions made based on the Subscription Services.
9.2 CasaNext’s total liability in connection with this Agreement shall not exceed the total subscription fees paid in the preceding 12 months.
10. Governing Law and Jurisdiction
This Agreement is governed by Moroccan law. Any dispute shall be submitted to the exclusive jurisdiction of the courts of Casablanca, Morocco.

T&C should be defined according to the specific needs and nature of each website. For example, a website offering products to customers in e-commerce transactions requires T&C that are different from the T&C of a website only providing information (like a blog, a landing page, and so on).
